What to Expect in the Guyger Trial

Contrary to popular opinion, manslaughter is NOT the correct charge.  It's no more correct than a DWI charge or Theft charge would be in this case.

No, under Texas law, Murder actually IS the proper charge, though I do NOT believe she "murdered" Botham Jean. 

This was an honest mistake and Amber Guyger WILL be found Not Guilty.  In fact, Texas law even wrote this into law as an exception, which is why Guyger will be found not guilty.  It's called "Mistake of Fact".  Those aren't my words, that's Texas law.  

And clearly, it was a mistake of fact.  Guyger thought she was at her apartment.  She thought she was at the threshold of her door.  She thought an intruder into her home refused to comply, thereby lawfully shooting Jean.

She will be found not guilty.
