Death Threats: Guyger Trial Day 6
Could there be a good appeal, if Guyger is convicted (I do NOT think it will happen, as mentioned in prior emails)? The Judge has limited the scope of defense so much--TOO MUCH--by my lay estimations..and by my legal expert Attorney Pete Schulte. Refusing to let the LEAD INVESTIGATOR of this investigation-a Texas Ranger, mind you-to testify on SOOO many things, may come back to haunt this judge. Also, remember when the Ranger who led the investigation testified away from the jury, telling us he does NOT think Guyger is guilty of ANY CRIME WHATSOEVER. That was done for the Appellate Court: In this racially charged case (a case which truly has nothing to do with race, save for the race pimps), seeing that African American Ranger tell us all that he told us, is tremendously powerful. They got his testimony on the record for the appeal, should there be a guilty verdict. Again, I believe 4-6 jurors will NOT convict at all. But, if they do, it will be based on feelings and not the law. Period.
Some things the Ranger couldn't bring up: Guyger's "psychological state". So many others, too. Too restrictive. Judge means well, but being too protective here.
Another big concern: When the Judge gives the "courts charge" or "charging instructions" ..this is where she tells the jurors EXACTLY what they must consider in order to find Guyger guilty of any crime she may be found guilty of. The question: Will she leave out critical options, like "mistake of fact"? That's what the truth is and that's what Texas law codifies as a reason to find someone not guilty in an incident like this tragic one.
A question folks are asking: Could Botham Jean have shot Guyger? Could they have shot each other? YES. It's HIS house. Castle Doctrine. She reasonably thought it was her house: Castle Doctrine, mixed with a shot of "Mistake of Fact".
The Jury is sequestered..Sunday, they're to hang out in their hotel, with no TV, phone, etc...
It's quite possible the Defense could REST on Monday. The Prosecution could present rebuttal witnesses. OR..it could be over. This could go to the Jury on MONDAY.
WHY did the defense wrap up so soon? The judge wouldn't allow their witnesses to appear..and the ones who did..could BARELY say anything!!! Former Dallas Deputy Chief Craig Miller was not allowed to testify..wow! He's the current DISD Police Chief. But what does he know, right? Same with Ranger Anderson who led the entire investigation..thank God they kept him out of the jury's view MOST of the time!! (ARGH!!)
SHOULD Amber NOT have taken the stand? My legal expert Pete Schulte thinks that-while Guyger did do some good in her testimony-some of the weak parts I chronicled left him wishing they'd not mentioned she was to testify at the beginning. BECAUSE..the Prosecution's case was so BAD. Interesting.
Observation I Forgot to mention from Day 5: The defense beat up Amber Guyger too much. Calling her a liar and interrupting her..not cool. I did NOT like it, neither did Schulte.
ALSO: I forgot to mention that Amber said she INTENTIONALLY killed Botham, thinking he was a threat (Mistake of Fact). That's actually IMPORTANT. It means there's NO WAY you can charge her with criminally negligent homicide or manslaughter. This was not reckless or accidental, nor careless. It was intentional and legal (mistake of fact). If this judge and jury does it's job, they're find her not guilty of murder. Period.
**Late Breaking: A witness got a death threat as soon as he/she got off the stand. My guess is that it's Ranger Anderson, the African American patriot servant who told the truth because that's what we all should do. If it wasn't him, it was probably the teacher from DISD who also told the truth. I am hearing their have been immediate calls for her to be fired. (this one is not confirmed, the death threat-though we don't have confirmation of who it is that was threatened because of the gag order-is confirmed)

With death threats and job threats, simply for testifying with honor and dignity..we're screwed when Guyger is acquitted or there's a hung jury. PLUS, there's now a LOT OF SECURITY. Remember, truth doesn't matter in this case (sadly)..the MOB MUST RULE; Amber MUST BE HANGED/FLOGGED, according to radical, dangerous fools who've been told again and again they're perpetual victims.
