Damning Evidence the Jury Won't Hear: Guyger Trial Day 3

Truly damning testimony from the Lead Investigator from the Texas Rangers, who is black (since race seems to matter so much in this case, sadly)!

Ranger David Armstrong says Guyger-in his professional experience-is not guilty of ANYTHING.  Not manslaughter, murder, negligence-nothing.  He believes she was reasonable in her belief that she was at her own apartment and that she had come across an intruder...and that her use of force was justified and legal.  Boom.  (Sidebar: This black Ranger is OBVIOUSLY A RACIST!!--joke!)

Why won't the jury hear this?  Because this part of Armstrong's testimony was addressing where HE thought Botham Jean was standing when he was shot.  SO..the Judge decided to let the Defense question him about this-with the jury out of the court room.  And, man, did he unload.  Said everything I've been saying for almost a year now: There is no case.

And THIS IS WHY I keep telling you NOT to be surprised when Amber Guyger is found NOT GUILTY of anything.  Because she's NOT.

It's a "mistake of fact", codified in Texas law.  She reasonably believed she was in her own apartment that night.

Other observations: Look for day 4/Thursday to have the Defense begin their questioning of witnesses.  And watch them kick A--.  They will.

What's so sad, as my legal analyst Attorney Pete Schulte has been saying-these Prosecutors have been handed a crap sandwich, and they know it-so they're TRYING to sell the case, but so far...EVERY DAY NOW...they have been making the DEFENSE'S case FOR THEM!!  Ouch! True, though!

BOOM: DPD Forensic Analyst even accidentally mentioned she had NO IDEA what floor she was on when she took one of the evidence pics, EVEN THOUGH it was part of the EVIDENCE in front of the jury!!  If SHE doesn't know what floor that was, how they HECK would GUYGER?!  

"The TV was huge, there was so much light for her to see"-Irrelevant if it's "her house", as she thought it was.  

"He was sitting on the couch"-The Ranger doesn't think so..but..IRRELEVANT, if it's "her house", which she thought it was.

"Were there any weapons in his hand or in the room?  Was he perceived as a threat??"-IRRELEVANT if she's at "her house", which she thought she was.

M.E. confirmed THC in Botham's system.  Will Defense ask for the actual LEVELS?? I hope so!  Attorney Pete Schulte's sources say the levels are HIGH.  That IS relevant to me: With possibly wearing Air Pods in his ears and way high, WHO KNOWS how he'd react to a perceived intruder..and..I believe he DUCKED during the shooting, which is why he was struck from the angle he was struck from-when they showed the red dowel rods to show the angle of the bullet today.

By the way.  The red dowel rods, showing the bullet angle/trajectory was particularly hard for me..so real.  So sad.  For all sides.  Horrific.  But legal.  

We ALSO found out Botham is 6'1"!! 10 inches taller than tiny Amber Guyger.  AND 247..with a BIG CHEST.  NOW--his size DOES NOT APPLY in this case: The size of the "threat" does not matter if they're intruding in "your home", but...this shows you even more how much of a "threat" Amber thought Botham was.  AND..the Ranger says he believes Botham was 13-15 feet from the door way.  Amber already was IN the apartment..at least 1-2 feet from door.  This hulking man (compared to her) was within 11-14 feet from her, coming toward her.

There is no case her.
