Sexting And Speculation: Closing Arguments on Day 7 of Guyger Trial

Strong closing arguments from the Defense today, as they tag teamed.  Weak arguments from the prosecution.

The defense is right to say that the prosecution wants to ENFLAME the jury with EMOTION.  Instead, they properly said facts and reason should sway their verdicts.

NOTICABLE: Only 2 charges were allowed for the jury to consider: Murder or Manslaughter.  No Criminally Negligent Homicide.  That's not good for the prosecution, but it's good for the defense.  It's not manslaughter because Guyger wasn't reckless or unintentional.  She testified she intended to kill.  It's murder or nothing.  And it will be nothing.

It will most likely be a hung jury, due to the fact that some probably will allow emotion to override logic.

Mistake of Fact has been instructed to the jury.  That defense is exactly what happened here, and everyone knows it.  She reasonably thought she was in her apartment, just like the Attorney, school teacher and others testified they did.  Just like the Texas Ranger say 1/4 of all residents on the 3rd and 4th floor have done.  The only difference: Botham Jean's strike plate on his door was defective, leaving his door commonly ajar, as it was that fateful night.

What an absurd theory you have to believe from the prosecution:  Jean was getting up on the couch when he was shot by the "murderer" Guyger.  If so, where's the blood on the couch?  How did Jean navigate around the ottoman and not collapse on the computer?  Why did he fall backwards?  No, he would have collapsed forward onto the ottoman 

I agree with legal analyst @AttyPeteSchulte who says he thinks Jean saw a cop in uniform, ran for weed to hide it and was shot, as Guyger thought he was running for him.  

Why was he shot at that angle?  I believe he was ducking down after the first bullet hit the wall.  Remember, he had air pods on, was high and was surprised.  How would he have reacted if he were sober and didn't have air pods in?  We'll never know.  Horrible tragedy.  No one wins.

Another ridiculous thing the state wants us to believe is that Guyger had all these choices, when she had 1-2 seconds in all this, and she didn't break in: She put her key in the fob and that pressure opened the door, as it was not closed all the way..it was ajar.  It opened.  She shot with 30 lbs of gear in her left hand/arm and with one hand..her right hand, retrieved her duty weapon and shot twice, as trained, a "double tap".  I believe the first one hit the wall, the second one Mr. Jean in the heart and subsequently the lung.

The other absurd theory from the desperate prosecution is that Botham hid behind the kitchen wall, a wall that was about 1/2 the height of the walls of the apartment..Dumb.  Where was the bullet hole through the wall?  Where was the blood there?  The body never moved, save for a shoulder being raised and legs being raised for treatment by the responding officers.

Lastly, Jurors could decide tonight or tomorrow..or Wednesday.  I will be shocked.  Shocked. If Guyger is found guilty of either.  Her first defense is Mistake of Fact.  Second is Self Defense.  They're both strong.  The jury needn't go to Self Defense.  If it's reasonable for an average tenant there to mistake their place, like Guyger, which we all know it was, it's over.  

IF the jury convicts on any of these two, it will simply be on their emotions and not the sober facts.
